High Court Rejects Bid to Challenge Agency Visa Review Decisions

The US Supreme Court on Monday declined to hear an appeal brought by a Vermont-based information technology company over federal court review of an immigration agency’s visa petition revocation.
US Citizenship and Immigration Services approved a petition from iTech US Inc. to sponsor a prospective employee’s green card in 2015, but revoked the petition a year and a half later, citing questions about the worker’s educational record and the company’s ability to pay the required wages. The company sued under the Administrative Procedure Act, alleging the USCIS’s decision to revoke the I-140 was arbitrary and capricious.
